Terms of Service

1. Introduction and Acceptance

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer," "you," or "your") and CryptoForge Security Technologies Ltd. ("CryptoForge," "we," "our," or "us") governing your purchase and use of our hardware cryptocurrency wallets and related services.

By accessing our website, making a purchase, or using our products, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use our website or products.

These Terms apply to all users, visitors, and customers of CryptoForge products and services.

3. Products and Services

3.1 Product Description

CryptoForge manufactures and sells hardware cryptocurrency wallets designed to securely store private keys for digital assets. Our products are physical electronic devices that provide cold storage solutions for cryptocurrencies.

Product specifications, features, and supported cryptocurrencies are subject to change. We strive to provide accurate product descriptions but do not warrant that descriptions are error-free or complete.

3.2 Eligibility

You must be at least 18 years old to purchase our products. By placing an order, you represent that you are of legal age and have the legal capacity to enter into this agreement.

4. Ordering and Payment

4.1 Order Process

To place an order:

  • Select the desired product and add it to your cart
  • Provide accurate shipping and billing information
  • Review your order details and total cost
  • Complete payment through our secure checkout
  • Receive order confirmation via email

4.2 Order Acceptance

Your order constitutes an offer to purchase. We reserve the right to accept or reject any order at our sole discretion. Order acceptance occurs when we send a shipping confirmation email. We may refuse orders due to:

  • Product unavailability
  • Pricing or product description errors
  • Suspected fraudulent activity
  • Restrictions in your jurisdiction
  • Inability to verify payment information

4.3 Payment Terms

We accept payment via:

  • Credit cards (Visa, Mastercard, American Express)
  • Debit cards
  • PayPal
  • Bank transfer (for Enterprise orders)

Payment must be received in full before order processing. All prices are in USD unless otherwise stated. You are responsible for all applicable taxes, customs duties, and import fees.

4.4 Pricing and Errors

Prices are subject to change without notice. In the event of a pricing error, we will notify you and offer the option to:

  • Purchase at the correct price
  • Cancel your order for a full refund

5. Shipping and Delivery

5.1 Shipping Policy

We offer worldwide shipping with the following terms:

  • Standard Shipping: Free worldwide shipping, 5-7 business days
  • Express Shipping: Available at checkout, 2-3 business days
  • Tracking: Provided for all orders via email
  • Packaging: Discreetly shipped in unmarked packaging

5.2 Delivery Times

Delivery estimates are not guarantees. Delays may occur due to customs, weather, carrier issues, or other factors beyond our control. We are not liable for delivery delays.

5.3 Shipping Address

You are responsible for providing an accurate shipping address. We cannot redirect orders once shipped. Refused or unclaimed packages may incur return shipping fees.

5.4 International Orders

International customers are responsible for:

  • Customs duties and import taxes
  • Compliance with local laws regarding cryptocurrency hardware
  • Currency conversion fees (if applicable)

5.5 Risk of Loss

Risk of loss and title for products pass to you upon delivery to the carrier. We recommend purchasing shipping insurance for high-value orders.

6. Returns, Refunds, and Exchanges

6.1 Return Policy

We offer a 30-day return policy from the date of delivery. To be eligible for a return:

  • Product must be in original, unopened packaging
  • Security seals must be intact and unbroken
  • All accessories and documentation must be included
  • Product must not show signs of use or damage
  • Original proof of purchase required

Security Notice: For security reasons, we cannot accept returns of opened devices. Once the security seal is broken, the device cannot be resold and will not be eligible for return.

6.2 Return Process

To initiate a return:

  1. Contact [email protected] with your order number
  2. Wait for Return Merchandise Authorization (RMA) number
  3. Ship the product with RMA number clearly marked
  4. Use tracked, insured shipping method
  5. Allow 7-10 business days for inspection and refund processing

6.3 Refunds

Upon approval of your return:

  • Refund will be issued to original payment method
  • Original shipping costs are non-refundable (except for defective products)
  • Return shipping costs are customer's responsibility
  • Processing time: 5-10 business days
  • Bank processing may take additional 3-5 days

6.4 Exchanges

We do not offer direct exchanges. To exchange a product, return the original item for a refund and place a new order.

6.5 Non-Returnable Items

The following items cannot be returned:

  • Opened or used hardware wallets (security risk)
  • Products with broken security seals
  • Items purchased during final sale promotions
  • Customized or personalized devices
  • Digital products (software licenses, firmware updates)

7. Warranty and Guarantees

7.1 Limited Warranty

CryptoForge provides a 2-year limited warranty from date of purchase covering:

  • Manufacturing defects in materials or workmanship
  • Hardware malfunctions under normal use
  • Firmware bugs causing device failure

7.2 Warranty Exclusions

This warranty does NOT cover:

  • Physical damage (drops, water damage, crushing)
  • User error or misuse
  • Unauthorized modifications or repairs
  • Loss or theft of device
  • Loss of cryptocurrency due to user error
  • Normal wear and tear (e.g., screen scratches)
  • Damage from improper storage or environmental conditions
  • Use with incompatible devices or software

7.3 Warranty Claims

To file a warranty claim:

  1. Contact [email protected] with proof of purchase and issue description
  2. Provide photos/videos demonstrating the defect
  3. Receive warranty claim approval or denial within 48 hours
  4. If approved, ship device to our warranty center (prepaid shipping label provided)
  5. Receive repaired or replacement device within 10-15 business days

7.4 Warranty Remedy

Our sole obligation under this warranty is to repair or replace the defective device at our discretion. Replacement devices may be new or refurbished. This warranty is non-transferable.

7.5 Enterprise Extended Warranty

CryptoForge Enterprise customers receive a 5-year extended warranty with priority replacement service and dedicated account manager support.

8. Proper Use and User Obligations

8.1 Intended Use

CryptoForge hardware wallets are designed exclusively for secure storage of cryptocurrency private keys. You agree to:

  • Use the device only for its intended purpose
  • Follow all setup and security instructions
  • Keep your recovery phrase secure and private
  • Never share your PIN or recovery phrase with anyone
  • Use only official CryptoForge firmware and software
  • Keep firmware updated to the latest version

8.2 Prohibited Uses

You agree NOT to:

  • Modify, reverse engineer, or disassemble the device
  • Use the device for illegal activities
  • Circumvent security features
  • Resell counterfeit or modified devices
  • Use the device in violation of export control laws

8.3 User Responsibility

You are solely responsible for:

  • Safeguarding your recovery phrase (seed phrase)
  • Verifying transaction details before confirming
  • Protecting against phishing and social engineering attacks
  • Ensuring device is not tampered with before first use
  • Backing up wallet data and recovery information
  • Understanding how cryptocurrency transactions work

9. Online Services and Connectivity

Certain CryptoForge models support connectivity features:

9.1 Companion Software

Our companion apps (mobile and desktop) require internet connection for:

  • Checking cryptocurrency prices and balances
  • Broadcasting transactions to blockchain networks
  • Downloading firmware updates
  • Accessing customer support features

Privacy Note: Your private keys remain offline on the device. Internet connectivity is used only for blockchain interaction, not key management.

9.2 Service Availability

We strive for 99.9% uptime for our online services but do not guarantee uninterrupted availability. We may suspend services for maintenance, security updates, or force majeure events.

9.3 Third-Party Services

Our products may integrate with third-party services (blockchain explorers, price feeds, exchanges). We are not responsible for third-party service availability, accuracy, or security.

10. Intellectual Property Rights

10.1 Ownership

All intellectual property rights in CryptoForge products, including but not limited to:

  • Trademarks, logos, and brand names
  • Hardware designs and schematics
  • Software and firmware (excluding open-source components)
  • User manuals and documentation
  • Website content and design

are owned by or licensed to CryptoForge Security Technologies Ltd. All rights reserved.

10.2 Open Source Components

Our firmware includes open-source components licensed under various licenses (MIT, GPL, Apache). These components retain their original licenses. Full source code is available at our GitHub repository.

10.3 Limited License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to use the device and software for personal or business purposes. This license does not grant you any intellectual property rights.

11. Limitation of Liability

IMPORTANT: PLEASE READ CAREFULLY

11.1 Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE"
  • WE DISCLAIM ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR PARTICULAR PURPOSE, AND NON-INFRINGEMENT
  • WE DO NOT WARRANT THAT THE DEVICE WILL BE ERROR-FREE OR UNINTERRUPTED
  • WE ARE NOT RESPONSIBLE FOR CRYPTOCURRENCY VALUE FLUCTUATIONS

11.2 Exclusion of Liability

CRYPTOFORGE SHALL NOT BE LIABLE FOR:

  • Loss of cryptocurrency due to user error (e.g., lost recovery phrase, incorrect transaction addresses)
  • Cryptocurrency theft resulting from phishing, malware, or social engineering
  • Blockchain network issues (e.g., network congestion, forks, protocol changes)
  • Loss of data or profits
  • Third-party actions or services
  • Regulatory actions or legal restrictions
  • Indirect, incidental, consequential, or punitive damages

11.3 Liability Cap

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY ARISING FROM OR RELATED TO THESE TERMS SHALL NOT EXCEED THE PURCHASE PRICE YOU PAID FOR THE PRODUCT.

11.4 Essential Terms

These limitations are essential elements of the agreement between you and CryptoForge. Without these limitations, we would not offer products at current pricing.

11.5 Jurisdictional Limitations

Some jurisdictions do not allow exclusion of implied warranties or limitation of liability for incidental or consequential damages. In such jurisdictions, the above limitations may not apply, and our liability will be limited to the maximum extent permitted by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless CryptoForge Security Technologies Ltd., its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use or misuse of CryptoForge products
  • Your violation of these Terms
  • Your violation of any law or regulation
  • Your violation of third-party rights
  • Your cryptocurrency transactions and activities

13. Dispute Resolution

13.1 Informal Resolution

Before initiating formal proceedings, you agree to contact us at [email protected] to attempt informal resolution. We will respond within 30 days.

13.2 Governing Law

These Terms are governed by the laws of England and Wales, without regard to conflict of law principles.

13.3 Jurisdiction and Venue

You agree that any legal action or proceeding shall be brought exclusively in the courts of England and Wales. You consent to personal jurisdiction and venue in these courts.

13.4 Arbitration (Optional)

For disputes exceeding £10,000, either party may elect binding arbitration under the rules of the London Court of International Arbitration (LCIA). Arbitration shall be conducted in English in London.

13.5 Class Action Waiver

YOU AGREE TO BRING CLAIMS ONLY IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

14. Termination

We may terminate or suspend your access to our website and services immediately, without prior notice, for:

  • Violation of these Terms
  • Fraudulent activity
  • Abusive behavior toward staff
  • Legal or regulatory requirements

Sections regarding liability limitations, indemnification, intellectual property, and dispute resolution survive termination.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy and any additional terms applicable to specific products, constitute the entire agreement between you and CryptoForge.

15.2 Amendments

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our website with an updated "Last Updated" date. Continued use constitutes acceptance of modified Terms.

15.3 Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall continue in full force and effect.

15.4 No Waiver

Our failure to enforce any provision shall not constitute a waiver of that or any other provision.

15.5 Assignment

You may not assign these Terms without our written consent. We may assign these Terms without restriction.

15.6 Notices

All notices to CryptoForge must be sent to [email protected] or our registered address. We will send notices to the email address associated with your order.

15.7 Force Majeure

We shall not be liable for delays or failures due to circumstances beyond our reasonable control, including acts of God, war, terrorism, pandemics, government actions, natural disasters, or supply chain disruptions.
